These terms apply to your use of Poker Club HQ’s apps and websites (the “Services”). By using the Services, you agree to these terms and to our Privacy Policy. If you don’t agree, please don’t use the Services.
You can use many features without an account. Some, like syncing and sharing, need one. You must be at least 16 to create an account.
If you create an account, give us accurate information, keep your password to yourself, and tell us right away at support@pokerclubhq.com if you think someone else has used your account. You’re responsible for what happens under your account, and you may not transfer it to anyone else.
We may change, add or remove features, and we may suspend or end your access if you break these terms. You’re responsible for the devices and internet access you use with the Services, and for following any local laws that apply to you and the games you run.
The Services include a free plan and paid plans. Paid plans are available as monthly subscriptions, and some as a one-time lifetime purchase.
Refunds for purchases made through the App Store or Google Play are handled by Apple or Google under their refund policies; we can’t issue them. For a purchase made on our website, you may request a refund within 10 days by emailing support@pokerclubhq.com with your account email, the date of purchase, what you bought, and why you’d like a refund.
You own the tournaments, player information, images and other content you add to the Services. You give us permission to store, copy, display and send your content only as needed to run the Services, including to the people you choose to share it with.
You’re responsible for your content. Only add information, including other people’s names, contact details and photos, that you have the right to share. Your content must be legal and must not be abusive, hateful, sexually explicit, deceptive, or infringe anyone else’s rights. We may remove content that breaks these terms.
If you send us feedback or ideas, we may use them without any obligation to you.
Don’t use the Services to:
The Services, including the software, design, text and graphics, belong to Poker Club HQ or our licensors and are protected by copyright, trademark and other laws. We give you a personal, revocable license to use the Services as these terms allow. You may not copy, modify, sell or reverse engineer the Services, or use the Poker Club HQ name or logo in a way that suggests we sponsor or endorse you, without our written permission.
If you believe content in the Services infringes your copyright, email our DMCA agent at legal@pokerclubhq.com with the subject “DMCA Notice” and include: a description of the copyrighted work and where the infringing material is; your name, address, phone number and email; a statement that you believe in good faith the use isn’t authorized; a statement that your notice is accurate and that you are the owner or authorized to act for the owner; and your electronic signature. Knowingly false claims can lead to liability for damages and perjury.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DON’T PROMISE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE OR FREE OF VIRUSES, OR THAT YOUR DATA WON’T BE LOST, SO KEEP YOUR OWN COPIES OF ANYTHING IMPORTANT. SOME LAWS DON’T ALLOW THESE EXCLUSIONS, SO THEY MAY NOT ALL APPLY TO YOU.
TO THE FULLEST EXTENT ALLOWED BY LAW, POKER CLUB HQ AND ITS SUPPLIERS WON’T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE OR DATA, ARISING FROM YOUR USE OF THE SERVICES, EVEN IF FORESEEABLE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WON’T EXCEED US $100. THIS DOESN’T LIMIT ANY LIABILITY THAT CAN’T BE LIMITED UNDER APPLICABLE LAW.
You agree to defend and indemnify Poker Club HQ and its people against any claims, losses and costs, including reasonable attorneys’ fees, that arise from your content, your breach of these terms, or your misuse of the Services.
These terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law rules. Please contact us first, since most concerns can be resolved quickly that way.
If we can’t resolve a dispute informally, you and Poker Club HQ agree to resolve it by binding arbitration before a single arbitrator under the rules of the American Arbitration Association, held in Jefferson County, Colorado, instead of in court. You and we each give up the right to a jury trial. The arbitration is confidential, and the arbitrator’s decision may be enforced in any court with jurisdiction. Either of us may instead bring a qualifying claim in small claims court, or bring an issue to the attention of a government agency. Any matter that isn’t subject to arbitration will be heard only in the state or federal courts located in Jefferson County, Colorado.
Any claim related to these terms or the Services must be brought within one year after it arises, or it is permanently barred.

We may update these terms from time to time. The effective date at the top shows when they last changed, and we’ll make a reasonable effort to tell you about significant changes. If you keep using the Services after an update, you accept the new terms.
These terms and our Privacy Policy are the entire agreement between you and Poker Club HQ about the Services. If any part of these terms can’t be enforced, the rest stays in effect. If we don’t enforce a term right away, we haven’t given up the right to enforce it later.
